The covered entity (CE), NAS Recovery Solutions, reported that three employees downloaded files containing protected health information (PHI) from its electronic health records system without approval or authorization. According to the breach report, the breach affected approximately 7,000 individuals. The PHI involved names, address/zip codes, dates of birth, and other identifiers. The CE notified HHS, the media, and the affected individuals. In its mitigation efforts, the CE sanctioned the employees and implemented enhanced access controls to prevent a reoccurrence. OCR provided technical assistance to the CE regarding the HIPAA Rules and received evidence substantiating the CE’s notifications.
